I have written enough about this issue that has no need of rehearsing here. So allow my comments on yesterday's vote to be brief.
Fix the Electronic Communications Privacy Act in such a way that Internet technologies will comport with Fourth Amendment jurisprudence to correct the most significant problems inherent in the "Patriot Act."
And then let's ask ourselves whether it is "secret courts" that we need or a return to Title III, regular criminal courts with provisions for protecting information relevant to a case while it is under investigation.
I believe most of what concerns the public and animates these debates will be addressed through these two approaches. Done properly, these changes would go a long way to reset a balance between civil rights and national security.
