Major Troubles for Decker College

The walls are closing in on Decker College, a for-profit institution based in Kentucky and partially owned by William Weld, a gubernatorial candidate in New York.

On Wednesday, Kentucky's attorney general, Greg Stumbo, announced that his office would investigate whether Decker -- which has operated a business program at its main campus in Louisville and construction schools in Louisville, Atlanta, Indianapolis, and Jacksonville, Fla. -- engaged in "false, misleading or deceptive practices" under the state's Consumer Protection Act.

Stumbo said he had been asked to investigate by the state's Board for Proprietary Education, following lawsuits by students accusing the college of misrepresenting itself. "I am determined to ensure that Kentuckians who want to improve their job skills are treated fairly,” Stumbo said. “People who invest money in their futures deserve to have those futures protected."

The attorney general's action follows by several days a decision by the U.S. Education Department to end Decker's participation in federal student aid programs. In a September 30 letter to Weld, Robin S. Minor, director of the School Participation Management Division of the department's Federal Student Aid office, said the institution had failed to comply with federal financial aid rules and breached its "fiduciary duty" to the federal government in "very severe" ways.

According to the department's letter, Decker:

  • Offered its associate applied science degree in construction crafts -- in which a majority of its students are enrolled -- primarily in an online format even though it was not accredited by the Council on Occupational Education to do so.
  • Failed to return $7 million in federal Pell Grant and loan funds that it owed to the department because students had dropped out partway through a term.
  • Received federally guaranteed loan funds on behalf of its students without prior approval from the Education Department, despite having been prohibited from doing that because of previous restrictions on its eligibility.

Because of those breaches, the department said, Decker is ineligible to participate in the federal student aid programs, including the Pell Grant and guaranteed loan programs, as of September 30.

The inability to award federal student aid is often the death knell for colleges. Decker has already wilted under the recent scrutiny, closing most of its branch campuses and ceasing to pay many of their employees last month.

Weld's investment firm, Leeds Weld, which he founded after leaving the governor's office in Massachusetts and invests heavily in for-profit higher education, is a minority investor in Decker. Weld's involvement with the college has become a minor issue in the New York gubernatorial campaign.

A spokeswoman at Leeds Weld referred calls to Mark Stein, the chief financial officer at Decker. Stein did not return telephone calls seeking comment.

  • For Rosa and any other person owed wages, not commissions, or in some cases salaries, but actual pay for hours worked, the U.S. Department of Labor is your advocate for non-payment of hours worked. And the U.S. Department of Labor will go after these people like a pit bull on steak. If there is any money lying around, they will recover wages for hourly employees, even in bankruptcies. Understand that in bankruptcies, often you will see any funds go toward legal fees, lawyers, court cost, but next in line are hourly employees. The laws governing who is and is not a supervisor / hourly employee have changed, but you may still be under the old definition. So contact your local office of the U.S. Department of Labor or go to their website at www.dol.gov and start from there. Good Luck.

  • I went to Decker College in 07/2004 and dropped out in 08/2004, and the school got a loan in my name without my knowledge and told the lenders that I have graduate from Decker College. Yeah right. I have been trying to go back to school and when it came to financial aid, I can't get it because of them. Advice. Call the lenders, and if you only stay for about 90 or less days, you can request a unpaid refund or closed school loan discharge. I am trying and willing to go back to school.

  • I have talked to the Attorney General's office, the bank my loan is through and The Kentucky State Board for Proprietary Education and I keep getting the run around. No one seems to know what to do. If I can't find out what to do I'm going to contact a local lawyer and see what the next step is. Here it is 4 years later and I'm still in debt to my ears, trying to pay off the loan, raise a child, and attend another school that I know is legit. I have changed majors to health since it is expanding so much but still really want to do Electrical.

    All of the recent public accounting scandals at the highest level have increased the sensitivity of the public and the legal authorities to these issues.

    It's sad that the students end up suffering when a school is involved in financial confusion because not only do they lose money but they may have wasted years of their lives.

  • I am a 2003 Graduate of Decker College, and when I attended Decker, I never recieved any of the Loan Money that I was suppose to recieve. Decker fired almost the whole finicial Department and most students did not recieve their checks. When I left Decker, they still owned me a check for 900.00 Plus.

  • This is probably news to some occupational college students, but students don't get "paid" for going to school. Those funds probably come from borrowing more than is needed on your student loans. You could check with your lender to see if that $$ shows in the loan records as paid to you or as returned to the lender (reducing the amount you owe).

    You could also contact the KY Attorney General's Office since they are investigating, at their website www.ag.ky.gov/news/2005rel/decker.htm they give a special email address: decker@ag.ky.gov. or you can call: 1-866-524-3672.

  • My experience with decker was that they were very eager to get me to sign up and I was reluctant because I heard of the bad news with decker college but they convinced me that it was just a unhappy student.
    After i signed up it would take hours before i knew what to do next;and the lab work was so bad that just 3 percent of the students were able to have the connections right.I was outhere working and studying hard and i dont feel that i can get a job as a helper

  • I am in my last year at Decker College. I was wondering if the Dept. of Education are going to still issue the Degree in Applied Science to the students that were to return for Graduation in February. If not, will there be referrals for us to attend another college.

    Also, I had grant monies come from different sources that Decker received. They were to send me any funds that were a credit to my account. When I tried to get answers from the financial office regarding this, I got an email, a call, but no paperwork nor my funds.

    I've seen many young people who were serious about their education and finishing it at Decker. I was referred to Decker thru a Construction Company of which I was doing some site work for. They partially paid for my education and I am sure they would like some answers as well.

    I need an answer from either the Lawyers for Decker or the DOE.

  • I also would like to know where are funds are and the teachers that liked to e-mail us and tell us when to have the work submitted. Since all of this has went down, us students have not had a call nor an email. We find out what is happening to Decker College on the internet. How is that possible that the administration can take our money and not give us any information? Is there a lawyer we can contact and would it do us any good? Or is it just like the degree we would of gotten?

  • so what now? if i was in the middle of taking courses, do we as students have to pay for our student loan? even though we haven't completed it? i am very disappointed, i should have known, i told a coulple of people when i was in atlanta in may, i guess someone was smart enough to call in an investigation team to investigate what was really going on. i personally, felt that i was rushed into this program, besides this the course was too quick, especially for electrical which covers alot of material. we need all the imput we need from all you students to help clear this situation out, besides it isn't fair to pay for a program that you never completed. email me for some other problems that i might have left out. e mail address is jinjehjoe@yahoo.com holla to all of 050505 class! that stayed at the amberly.

  • I knew that this would end badly and so did the owners of Decker. In fact I believe they planned on it. I tried to get this stopped before it could do the damage that it did but I was stopped by Decker. I believe they knew that this would be such a mess that people would find it nearly impossible to find an attorney to file suit pro bono or on contingencey. Hopefully someone goes to jail for this mess. I hope William Weld and the gold spoon he has in his mouth is one of them. I am sorry for how everyone was mis-led and hopefully the outcome is favorable by everyone affected but I am afraid it will not. Nothing in life is fair but there is no excuse for what has happened here. You must find a way to let your story be told and stop this from happening again. John Boener is the chairman of the Committee on Education and the Workforce. He has been fighting to make it easier for the Decker Colleges of this country to get the Department of Education's funding in the back pockets of the greedy elite(your tax dollars) for this kind of crap. So I ask you to write your congressman,contact your media and stand on a milk crate in the middle of a crowd if you have to if that is what it takes. DO NOT LET THEM GET AWAY WITH THIS!!!!!!! IT IS UP TO YOU THE INDIVIDUAL AND AS A GROUP YOU CANNOT BE DEFEATED ORGANIZE AND FIGHT FOR WHAT IS RIGHT!!!!!!!

  • When I heard of the prices going up and the students being taken advantage of, I tried to make a difference. Because of this I got fired. You'll notice in all of the news clips that 500 of the Decker employees got laid off in Aug and Sept. Something happened and the reps of Decker didn't know what to do.

    I hope all of the students get what they've got coming to them. I hope you either get your certification or get your money back.
    What happened was wrong and I hope this bad karma gets set straight.

  • My son a few of his friends went to Decker College (Atlanta) in August. As a parent I am very upset that an organization would take advantage of some's life. My son and his friends were so excited about getting the training Decker promised them. As a mother I was really concerned everything just sounded to good to be true and all of you that felt you were rushed I felt the same way with my son, he was rushed into getting all my financial information for financial Aide to be approved. I pray to God that you all will stand together and not allow Decker College to get away with this. If anyone has already contacted a lawyer please send me the information so that my son and his friends may contact the same lawyer. DO NOT ALLOW THEM TO GET OFF SCOTT FREE.

  • My sister and I were attending Decker in Lousiville for a medical program. We had two more weeks and we would of been done. Now I have 10,000 dollars in loans and not one single thing to show for it. We will never see that certification or maybe never even our money. I just want some answers. I want the DOE or the state to tell me whats next for the students.

  • listen this crazy they told me everything was fine when i went to atlanta back in june 1 to get my level 1 hvac . now im suppose to be going back to shool for mylevel 2 what am i suppose to do now i wasted almost 1 half of a year studing and going to school i can't even get a job i my feild becouse i need 1 more level to be a helper what am i suppose to do now i'm out lots of time and money not counting all of hard time i had to try and keep my bills caught up while i was in atlanta for a month some one please help???!!!!!

  • I graduated in 2001 with a certificate in Medical Office but cannot transfer any of the credits to another college to further my education and then to top it all off, paying 10,000 for nothing!!!!???   • My name is Erik Black,and I was a student since March 5,05.I am supossed to have my level one certification as an Electrician. I'm upset because my entire class studied hard.I mean VERY VERY hard for an opportunity to turn our lives around in a positive manor. I LOVED going to class,after staying up all night getting right for THREE exams a day. And we all felt good about passing those tests we had taken.I wanted to move on with my certification,but I keep being turned down because of the schools reputation. I feel VIOLATED!!!!!!!!!

I my~self is upset for all that is going on. I was looking forward to getting my degree which decker had promise i think all of us.   • I needed only about 4 more courses to graduate, but even if i had completed them I wonder if i would have even received a degree.

    I was going for my MCSE, but looking back now im pretty sure that i could get certified by just doing some self studying. So basically all that money i have to pay back went no where. Now I have a huge loan.

    So I have 2 years wasted and no degree.

  • As a former employee of Decker College I take great pleasure in following all stories on the "net" involving the on-going ivestigation into possible illegal acts. I look forward to the day the the truth come out and I can testify to the facts of the fraud they committed on a daily basis to fill up school seats. I would encourage each student to e-mail me if you desire to take legal action, I (Director of Addmissions) and my wife(Financail Aid) will certainly answer any questions to your lawyers.   • I attended Deckers campus in Louisville Ky, and around the first of September we finally were completely aware of everything that was going on. Worried about where i would end up i transferred to a new school the 10th of this month and found out that my 34 credits were absolutely no good. and that decker got over 7,000 dollars in just 9 months. i was also told that come March, i would have to pay $800 so that i could attend from April until June because i cant apply for aid again until June. the reason is because decker used up most of my aid in that short time for the year. If anyone has any info on how to go about having that money put back onto my aid, or if thats even possible, please email me at kcolin23@hotmail.com, and i am fully in agreement that we should all stand together and do something about this.

    I am truly heartbroken that I wasted a year with them. Although i have a great job working for Metro Government, I feel used and hurt that the school didn't treat me like I a Human Being. Can someone help me into taking legal action or help me to be HEARD. I deserve an explanation, an apolgy, and my certificate. Please HELP!!!!!

  • I'm from Indianapolis, and the same thing happened on that campus. Fortunately, I was the first class to "graduate". The education we received was bogus. I am currently in another ACCREDITED school, and I will have an associate degree in applied science by going once every two weeks, for 5 years, while I work. I still would like info about this lawsuit, because I owe $6,000 to the D.O.E and my certificate is just a piece of paper that no one acknowledged when I went job hunting.   • I was supposed to return to Decker College in Louisville, KY on the 7th of September to complete the final 2 weeks to get my AAS degree in Electrical. It was postponed and I have now since found out that no students will be returning to Decker College. I am currently making loan payments for the $10,000 borrowed to complete this education and have nothing to show for it. I have heard that there is potentially a class action lawsuit geared toward assisting other students in similiar situations as me. I am interested in speaking with any lawyer or other advisor who may be able to assist me in either completing my degree or having my loan cleared.   • I started Decker COllege back in July of 2004 with hopes of getting a college degree and skills to become an electrician. I had completed all the test and was supposed to graduate in November 2005. Now I am stuck with loan bills and no degree. I was striving to become the first person in my family to graduate from college and now Decker has stolen my dream. I wasted time and now it may even cost me money only to have nothing to show. I found this to be a low budget school funded for poor people, but in the end......we were all equal... poor, unfortunate souls who wasted our time in the hands of lost captains....well Decker, may your ships remain lost, your captains adrift..and your destiny's sunken.

  • Because of Decker's promises, I quit my job, sold my truck for my financial needs and lost lots of time of work. Decker College promised to help/place me in a good paying job and still to this day I am not working as an electrician. I am also not about to start paying money when I am not even attending school any longer. I lost money and time and now am ready to do something about it. Now I am having a hard time with my credit cause of Decker's creditors showing up on my Credit Report. Please contact me if I could get involved in any action being taken.

  • My son was a student from late February 2005 - late Sept. 2005 when he withdrew due to the problems with the college. We have just found out that the college never certified his attendance with the Stafford Loan lender after April. His loan went in to repayment status in Oct. plus they show a subsidized loan he didn't have that he now owes for. The loan people say we have to get his enrollment records but how do we do that since the FBI seized the records? Has anyone else had this problem? I'm very interested in a class action suit if anyone has information on that.

  • It is my sincere prayer that previous students, and employees, of Decker College can somehow weather this storm created by the owners of the school. In defence of education, the concept could have worked if the owner's motivation had been education rather than profit. I wanted to institute a pre-enrollment exam which would have identified only the qualified. Unfornunately, Decker wanted no part of it. They wanted anyone who could qualify for a loan, NOW! Many students were truely there for an education. Unfornunately, too many were there for a place to crash for 4 weeks and $20.00 a day to party with. Decker students were kicked out of every hotel/motel in Louisville where the school tried to house them. In many instances, instructors feared for their own safety in the class room. We were sent students that couldn't add 2 and 2 or do simple fractions and we were suppose to make electricians out of them, a very technical occupation. None were more devastated than the dedicated staff and faculty at the collapse of Decker College. They poured their hearts into it only to have them ripped out as result of ownership greed.

    During our conversations you voiced your opinions to me from the very beginning about what was going on at Decker. You even told me how you being a christian man that offended you and that you were thinking of quitting. But situational ethics(hypocracy) allowed you to stay till the very end didn't it? You and others involved tried to play this up as a Union Non-union thing. Now what do you say? Bottom line is you did not care and I did. We both know this was a scam and nothing else but you and I followed very different roads. I knew the longer this went on the more damage it was going to do to people. But you did not care! The only thing that concerned you was your paycheck and not having to have to go back out into the field. When you read this I hope it makes you ask how you can sleep at night.   • Brian, To you it was always a union/non-union thing. Thats why you hired in under false pretenses as a union salt. You illigally removed confidential files, mine and others, to pass them on to the union, then hid in another county to avoid arrest.
    Yes, I thought about quitting, but I'm not a quitter. I remember you didn't quit, but got fired for stabbing the backs of the ones who hired you and signed your check. I sleep very well at night. You didn't make a very good spy. Not a very good electrician either according to some of your previous employers I came in contact with.

    I want to officially retract and apoligize for the statements I made in my last comment. I was out of line and using unsubstantuated information passed on to me by previous supervisors. Enough damage and hurt has been done already. I respect you as a person and just want to let this sleeping dog lie. I truely wish you a good life.

  • Number one I did not ever remove classified information from there. Two I never hid in another county and three I was never in danger of being arrested. If I stabbed anyone in the back by notifying students that the school was not recognized by the state of Kentucky toward getting an electrical license in 4 years or letting veterans know that the schools program was not even approvable towards using GI benefits then so be-it. And nothing was more of a concern to me than the fact that as long as they continued to enroll students the greater the number of victims. This will not go away anytime soon Cline it is going to take years. Did you know that students who got personal loans cannot seek bankruptcy protection? That they can have there wages,income tax returns and even social security garnished.

  • i previously attended Decker College and ended my schooling there about weeks before they closed the doors in Louisville. I have contacted an attorney and was told that there is nothin I can do because they are filing bankruptcy. In almost 10 months I accumulated 34 credits and $7000 in loans that has to be paid back and credits that are useless at any other school. I have heard several people say that they are filing a class suit against Decker. I am interested in joining this suit, if not to late. If anyone has any information on how to do this, or actually knows for sure that there is nothing that can be done, the information would be greatly appreciated. Also, if the information is to be true, and you know of the attorneys name that is to be handling the suit against Decker, could you provide that as well. Thanks for your time.

    Was a lawsuit filed on behalf of the staff for unpaid wages? If so, who is the representing attorney(s)?

    What "Bonds" did the school maintain to cover the bad acts of the administration? and Who is the insurance carriers?

  • Call Elaine Brumback @ 1-800-928-8926 ext.7278. She is with the Kentucky Higher Education Dept. I have been in touch with her and she has so far acknowledged that my loan has been discharged. I am waiting for a verification letter from her but, so far I'm happy with the response I've received.
