The Markup—Aug. 14, 2026

By  Katherine Knott

Hello and welcome back to The Markup, Inside Higher Ed’s weekly roundup of all things higher ed policy. I’m your host, Katherine Knott, IHE’s news editor who misses shopping for back to school supplies. My notebook/binder game was strong, y’all!

The Trump administration has now sued 17 states over their policies that make some undocumented students eligible for in-state tuition. Only six states with such policies remain unaffected so far by the Justice Department's nationwide campaign against what are known as tuition-equity laws.

And in the latest development in Trump’s battle with Harvard, a federal judge dismissed the administration’s civil rights lawsuit against the Ivy League institution. The DOJ had alleged Harvard violated Title VI by not sufficiently responding to reports of antisemitic harassment, but the judge said the government didn’t present enough evidence to prove that Harvard is currently out of compliance.

This Week’s Big Story

So let’s talk about funding for education research. The Education Department’s research arm— the Institute of Education Sciences—has been a focus of government criticism since Trump took office. In the early months of 2025, the administration gutted the office and cut more than $1 billion in its contracts, raising questions about the federal government’s support of education research.

More recently, advocates have warned that millions in funding for research grants could expire by Sept. 30. The specific amount of money at risk is unclear, but public records and court filings put the total at about $316 million.

After a group of education-research groups sued the Education Department earlier this summer, ED officials are saying they intend to spend the money in a timely manner. But the plaintiffs question that assurance, in part because the spending plan is vague and hard to interpret.

Your co-host, Jessica Blake, has much more here about where things stand with IES now.

‘Call to Action’ Updates

Pushback is building to Education Secretary Linda McMahon’s request for colleges to detail their plans for reform. Two groups this week warned universities that the “Call to Action” threatens to fracture higher ed. Meanwhile, Jessica talked to several experts about how institutions should respond, if at all. Leaders need to be careful, they said, because their responses could make them a target of the administration.

And associations representing community colleges and regional public universities said in a joint response to McMahon that their institutions are already working on the principles and practices identified in the letter.

“The critiques in the letter appear to target institutions without the mission focus of our members,” they wrote. “Clarifying this important distinction is essential to recognizing the extraordinary work already accomplished by our institutions. … We are eager to ensure that reforms designed for one kind of institution do not impose unintentional burdens on others.”

In Other News

  • The Trump administration’s crackdown on race-based policies continues as the Justice Department declared three NSF programs unconstitutional. Reporter Olivia Sanchez reports on the threat to long-running programs that aim to help students from underrepresented backgrounds earn STEM degrees, build capacity for STEM education at Hispanic-serving institutions and diversify STEM faculty.
  • Education Secretary Linda McMahon was sued in 2024 for allegedly ignoring sexual abuse when she was a WWE executive. Reporter Josh Moody dug into the case this week. The lawsuit is now in the discovery phase, raising the possibility that McMahon could be deposed in an effort to determine what she knew about the reported abuse.

That’s it for Week 82 of the second Trump administration. As always, if news breaks today or over the weekend, you can find the latest at InsideHigherEd.com. In the meantime, I’ll be working on a puzzle while I await more breaking news.

“I think most college leaders will find it difficult to read that letter any other way than ‘if you do this, you’re with us, and if you don’t, we’ll have no choice but to assume you’re not.’” — Jodie Crosby Ferise, a former university administrator and now partner at Church Church Hittle and Antrim Law, on the “Call to Action.”
