Court Rules Against Teaching Hospitals on Medicare Reimbursement

Academic medical centers may not seek federal reimbursement under Medicare for research done in the 1980s and 1990s by medical residents that was not directly linked to patient care, the U.S. Court of Appeals for the Seventh Circuit ruled Monday. The appeals panel's decision, which came in a case involving Chicago's Rush University Medical Center, overturned a lower court judge's decision and upends the Seventh Circuit's own 2010 ruling involving the University of Chicago. But that 2010 ruling, the Seventh Circuit said on Monday, no longer holds because of a regulation that the U.S. secretary of health and human services promulgated in the wake of the Affordable Care Act.
