The U.S. Court of Appeals for the Fifth Circuit has declined a request that it review a decision by a three-judge panel of the court that upheld the legality of affirmative action programs used at the University of Texas at Austin. Lawyers who challenged the lower court's ruling have indicated that they plan now to take their appeal to the U.S. Supreme Court, where many have predicted the case (already reviewed there once) was bound to return.
