A former Yale University basketball captain who was expelled over sexual assault allegations will be allowed to continue his lawsuit against the institution, a federal judge ruled Monday.

U.S. District Judge Alfred Covello declined to dismiss most of the claims made by Jack Montague, who was kicked out of the university in February 2016. Montague accused an administrator of coercing the woman who reported him for sexual assault, among other allegations. The woman, who is only known as Jane Roe, told the university that her encounter with Montague was not consensual.

The lawsuit states that Roe agreed to cooperate with Yale’s investigation only after an official informed her that Montague had already received sensitivity training in another sexual misconduct case, in which he allegedly shoved a folded paper plate down a woman’s shirt.

Montague said he was denied a chance to defend himself at length during the hearing where administrators decided to expel him.

Covello did toss out Montague’s complaint that the university discriminated against him because he was a man.

Yale did not respond to request for comment.
